LAST REMINDER 
Employers must conduct annual queries by January 5, 2021
 
If an employer has already conducted a query on all currently-employed CDL drivers, that employer has met the annual query requirement, and is not required to conduct a query for one year from the query date.

Employers may also designate a consortium/third-part administrator (C/TPA) to conduct these queries on their behalf. Employers can log in to their Clearinghouse accounts and access their Query History page (under My Dashboard > Queries) to verify which drivers have been queried, and when each completed query was conducted.

If an employer has not yet conducted a query on each currently-employed CDL driver, the employer must conduct this annual check to meet the compliance requirement.
 
What do employers need to do to satisfy the annual query requirement?
 
Per § 382.701, employers of CDL drivers must conduct a query of the Clearinghouse at least once per year for each CDL driver they employ. A limited query satisfies the annual query requirement.

Employers must obtain a general consent from CDL drivers they employ before conducting limited queries in the Clearinghouse to view these drivers’ information (you can download a sample limited query consent form).

You can log in to the Clearinghouse and conduct your annual queries today.

New CMCA Board Chairperson

 

At a recent meeting of the  Colorado Motor Carriers Association (CMCA), Suzanne Kutsch, the Vice President of CAST Transportation, was selected as its Chairperson of the Board for the upcoming year. 

 

On being selected as the Chairperson for CMCA, Mrs. Kutsch commented that “I am honored to have been chosen by CMCA’s Board to lead our industry and association during this pivotal time when our state and industry face a number of challenges. CMCA has a long and distinguished history of service to Colorado which mirrors that of my own company, CAST Transportation and I look forward to continuing that legacy.” Additionally, Mrs. Kutsch is apart of the first father-daughter pair to both serve as chairpersons, as her father is a previous chairperson of the Colorado Motor Carriers Association.

 

Greg Fulton, the President of CMCA, noted that “Suzanne is an outstanding businesswoman, and community leader. We are extremely fortunate to have someone with her skills and talent in leading our organization over the next year.”

 

Mrs. Kutsch is a third-generation owner and vice president of the CAST Transportation. She graduated from Fort Lewis College in Durango in 1994 earning a BA in Business. After graduation, she went to work in the family trucking company, South Park Motor Lines, Inc. dba CAST Transportation. Today, she is responsible for Internal Operations. Suzanne, her husband, and their son live in Littleton.  They enjoy the Colorado mountains, bike rides, playing cards and playing with their two corgis.

§  They should include language stating that your organization does not discriminate on the basis of any protected category with respect to the payment of wages.

§  Internal procedures:
  • Clearly state that all job postings, including opportunities for promotion, must
    include the job title, compensation and benefits (as discussed above), and the means
    by which employees may apply for the position.
  • Include the method of communicating promotional opportunities to employees.

What Should Colorado Employers Do?

  • Update all job postings for Colorado employees to include the compensation and
    benefits.
  • Postings also should include a disclaimer related to the posted compensation range.
  • Conduct a pay-equity audit.

The Division of Labor Standards and Statistics (“DLSS”) in the Colorado Department of Labor and Employment is writing to inform you of new rules taking effect January 1, 2021, as well
as new published guidance and workplace posters on those rules, and on various new laws
they implement. (These are the same rules DLSS stakeholders were informed of in an invitation to DLSS’s August pre-rulemaking stakeholder meeting, then in a September email distributing all proposed rules, and inviting all to comment and attend our November rulemaking hearing.) Following all pre-rulemaking and rulemaking processes from August through November, final versions of the rules were adopted and approved in November.

 

The DLSS rules website lists and links each set of rules, a redlined copy of each, and the explanatory rulemaking filing accompanying each (the statement of basis). For ease of reference, below is a direct link to, and summary of, each set of rules, with links to the
statutes they implement as well.

Following the November rule adoptions and approvals, DLSS updated its published guidance and resources to reflect these new laws and rules, and posted updated versions of the following on December 1, 2020.

CDC Updates Guidance for Long-Haul Truck Drivers
 
The Centers for Disease Control and Prevention (CDC) has provided updates to its coronavirus-related recommendations for long-haul truck drivers. Beyond the basics for protecting oneself and others, the CDC explains that mental health and emotional well-being, important parts of worker safety and health, have been challenged by the pandemic. To address heightened stress, anxiety, or depression, the CDC recommends paying attention to these feelings in yourself and others and being aware of resources available to manage them. View Guidance
