OSHA Formally Withdraws ETS

This morning, OSHA announced that it is withdrawing its vaccinate-or-test emergency temporary standard, effective upon publication in tomorrow’s Federal Register. On January 13, the Supreme Court had stayed the ETS pending full resolution of the challenges filed by ATA and other groups, and making clear that those challenges were going to succeed on the merits because, in the Court’s view, OSHA did not have the authority to promulgate this ETS. With this notice, OSHA chose to withdraw the rule rather than continue the litigation in the court of appeals. However, OSHA indicated that this withdrawal does not affect the notice-and-comment rulemaking that the ETS commenced, leaving open the possibility that OSHA will try to promulgate some kind of covid-related standard under its non-emergency authority. CMCA will continue to monitor those efforts and update members on significant developments.

 

We want to thank ATA for their hard work and diligence for getting to this stage, and continuing to update us on the issue.

FMCSA Publishes New Vision Standard Alternative

FMCSA published in the Federal Register a final rule amending the regulations and process for individuals with a vision impairment to become medically certified. This new “alternative vision standard” will replace the current vision exemption program that is in place today.

 

The current vision waiver process is being replaced with updated medical guidelines and a requirement for a Road Test.  This new process will be similar to the process insulin-dependent drivers must go through (i.e., seeing a specialist in addition to a medical examiner).  The effective date is March 22, 2022.

We highly recommend each of our member companies to submit nominations!  This is a great opportunity to recognize your company, drivers, and safety professionals for their dedication to highway safety.  Please read the enclosed information carefully, as some changes have been made.  Awards will be presented at the Safety Awards Banquet to be held on April 8, 2022.

2022-23 Ray Smith Scholarship Applications Available - Please share with your Employees!

 

The CMCA Scholarship Committee met and has released applications for the 2022-2023 Ray Smith Scholarship Program.

Eligible recipients include High School graduating seniors to returning College and Technical School students.  Scholarships valued at up to $2,500 will be awarded in May.

 

Annually, the Ray Smith Scholarship program helps fund continuing education / training for worthy students furthering their academic or technical training.  The Scholarship Program is funded through generous donations from CMCA members, memorial gifts and other fundraising activities.  For more information on the program, visit our website.
