Help Us Keep Interstate Commerce Moving - Ask Sen. Gardner to Clarify F4A
The battle is now on in Washington to clarify the Federal Aviation Administration Authorization Act, also known as F4A. The additional language would clearly denote that it pre-empts states, such as California, from regulating interstate commerce. While ATA and CMCA have been working diligently on this matter, we will need your help if we are to be successful.

 U.S. DOL Withdraws Independent Contractor Guidance
U.S. Labor Secretary Acosta announced some good news for the trucking industry on June 7 the withdrawal of informal guidance on worker classification and joint employment issued by the Department of Labor’s Wage and Hour Division in 2015 and 2016. In the 2015 guidance, the WHD advanced a new interpretation of the federal Fair Labor Standards Act, departing from decades of settled precedent and representing an escalating attack on the independent contractor model. The 2016 guidance similarly announced new, expansive standards for determining joint employment.
As DOL makes clear in this new announcement, withdrawal of the interpretations does not change the underlying legal responsibilities, because they did not have the force of law. However, the move suggests the current DOL’s approach to worker classification and joint employment issues will depart significantly from the prior administration. Courtesy of ATA/TAEC Weekly Update

Notice on Minimum Liability Insurance Rulemaking Withdrawn
FMCSA recently announced it was withdrawing the advance notice of proposed rulemaking it had issued in November 2014, which contemplated raising minimum liability insurance levels for motor carriers. In issuing the withdrawal, FMCSA concluded that it does not have (nor did public comments provide) sufficient data to perform the kind of systematic cost-benefit analysis that would be necessary to raise insurance minimums.  CDOT warns truckers: Beware 'the wolf' on Highway 160
VALLEY – Dryer roads and mild weather can mean safer driving conditions for most motorists. However, when traveling through Colorado’s mountains, semi-truck drivers can encounter challenging and dangerous conditions regardless of the weather. The Colorado Department of Transportation (CDOT) is warning big rig drivers to use extreme caution when traveling over mountain passes, like US Highway (US) 160 Wolf Creek.   Read More...
