Change to Employee Screening Requirement for COVID-19

CMCA has been working very hard with others over the past 10 days on trying to modify the employee screening process as outlined in the Governor's Safer at Home Order.  That order would have required companies to screen all employees daily on-site prior to starting the work day.  As you are aware, that requirement would have been difficult for many of our members to implement given the type of work environments in trucking.

 

Our team worked over the weekend with state officials on the matter along with the Executive Director of CDOT, Shoshana Lew and John Putnam, the Policy Director for CDPHE.  We outlined issues and concerns with the policy as well as an alternative which placed the responsibility more on the employee to do a self-check for symptoms prior to coming to work along with some training of our supervisors on recognizing signs of symptoms of COVID in employees.  

 

We received a draft of the revised guidance that will be published shortly.  The language recognizes many of our concerns.  We will publish the guidance as soon as we receive the approved document.  In the meantime, attached is an updated sample symptom tracker for employers.

Hand Sanitizer Available TODAY at TCA in Commerce City

Our mission to distribute 550 gallons of hand sanitizer across the country is underway. As truckers continue serving on the frontlines during the COVID-19 crisis, ATA and member-company ABF Freight are hauling ten 55-gallon drums of hand sanitizer, purchased by Protective Insurance, for distribution in eight states, where drivers will be able to refill their personal supplies at no cost.

FMCSA CONSOLIDATES PINS

NATIONAL - Consolidation of USDOT PIN and MC/MX Docket PIN The Federal Motor Carrier Safety Administration (FMCSA) Office of Registration will soon consolidate the USDOT, MC and MX Personal Identification Numbers (PIN) into one USDOT PIN. This system deployment effort will eliminate the need for multiple, MC and MX PINs.   
Who’s Impacted?
All carriers and other FMCSA regulated entities. After deployment, customers will only need a USDOT PIN to access FMCSA systems. If an alternate PIN (e.g., MC) is used, the system will notify that the information does not match the record on file and they will be prompted with a link to reset or request a USDOT PIN.
When is the change taking place?
Expect to see the change in FMCSA systems beginning April 27, 2020. When deployed, you will only be able to use its USDOT PIN to access FMCSA systems, submit changes and request updates to its US DOT and operating authority records. Updates can be done online via the FMCSA online registration system or by selecting the “FMCSA Registration and Updates” link under FMCSA Services from the SAFER website.

Joint Research Confirms COVID-19 Impact on Trucking

ATRI, OOIDA Identify Impacts and Recommendations

Atlanta, Georgia – The American Transportation Research Institute and the Owner-Operator Independent Driver Association Foundation today released important research on impacts that the Covid pandemic is having on all aspects of trucking operations, including deliveries, travel times, detention and truck parking. Most importantly, the research provides recommendations and guidance on future strategies should another national disaster strike.

 

“The trucking industry has weathered national disasters in the past, and is doing so again through the current COVID crisis,” said ATRI President and COO Rebecca Brewster. “However, this latest data quantifies the challenges motor carriers and drivers are facing during this pandemic to keep essential goods moving.”

IRS Issues FAQ and Guidance for Employee Retention Credit

The IRS has (finally) released guidance as to how the Employee Retention Credit will be implemented and for businesses to follow.  The guidance may be found here.  Since it runs to 94 questions, it’s easier to post the link.  

 

It is important to note up front that, pursuant to the CARES Act, a business that has successfully received a PPP loan cannot then participate in the Employee Retention Credit.  This is reinforced in the new guidance.

NM Institutes Checkpoints Surrounding Gallup


Due to the increased volume of COVID-19 cases in / around Gallup, NM the state has restricted access to the city. 

 

Checkpoints have been setup at multiple points of entry into Gallup. Motorists should expect to stop at these locations. Signs will be posted at least a half mile out, warning drivers of checkpoints ahead.

Crash Preventability Determination Program Made Permanent

On Friday, FMCSA announced the long-anticipated Crash Preventability Determination Program (CPDP). This program is a permanent, expanded program as a result of the demonstration program that ended on July 31, 2019. The Federal Register notice can be found here, and is expected to be published next week. Once published, the program will be officially open for submissions.

The Notice is still under review, but here are a few preliminary details:

  • Eligible crash types have been expanded, to include the 15  total crash types proposed in the August 2019 notice. However;
  • The 15 eligible crash types have been rearranged and  like crash events have been grouped together. The result is 10 categories of crashes that are eligible for review:
    • Struck in Rear
    • Wrong Direction or Illegal Turns
    • Parked or Legally Stopped
    • Failure of the other vehicle to stop
    • Under the influence
    • Medical Issues, Falling Asleep, or Distracted Driving
    • Cargo/Equipment/Debris or Infrastructure Failure
    • Animal Strike
    • Suicide
    • Rare or Unusual 
  • FMCSA added “Rare or Unusual” crash types to the eligible list. The examples for this are crash types “that seldom occurs and does not meet another eligible crash type (e.g., being struck by an airplane or skydiver or being struck by a deceased driver);
  • FMCSA indicated the possibility of expanding crash types over the next 24 months;
  • SMS scores will  not reflect crashes that were reviewed and determined “not-preventable”;
  • Motor Carrier’s list of crashes on the public SMS website will reflect “not preventable”, “preventable”, and “undecided”;
  • Pre-Employment Screening Program (PSP) reports will note crashes that were determined to be “not-preventable”;
  • A Police Accident Report (PAR) must be submitted when challenging a crash;
  • Once the FR notice is published (expected next week), eligible crashes occurring on or after August 1, 2019 can be submitted;
  • A new website for the CPDP will be used: www.fmcsa.dot.gov/crash-preventability-determination-program.
