Pre-employment Investigations for Drug and Alcohol Program Violations  
 
Beginning January 6, 2023, a pre-employment Clearinghouse query will satisfy the requirement to investigate a prospective driver's previous drug and alcohol program violations, as set forth in 49 CFR 391.23(e)(4) and 382.413(b). 
 

Employers of CDL drivers are required to conduct background investigations before hiring a driver. This process includes determining if the driver has violated the drug and alcohol regulations of any Department of Transportation (DOT) mode within the past three years (see 49 CFR 391.23(e) (1)-(3) and 382.413(a)). Currently, this requires employers or their designated consortia/third-party administrators (C/TPAs) to conduct both electronic queries in the Clearinghouse and manual inquiries with previous employers to meet the three-year time frame.

 

Beginning January 6, 2023, when three years of violation data is stored in the Clearinghouse, prospective employers must conduct a pre-employment query of the Clearinghouse, as set forth in § 382.701(a), to comply with the inquiry requirement in §§ 382.413(b) and 391.23(e)(4), as it pertains to FMCSA-regulated employers. Inquiries not conducted under § 382.701(a) will not satisfy these inquiry requirements.

Town of Vail implements new loading and delivery regulations:

 

As of October 1, 2022 The Town of Vail has adopted new loading and delivery regulations for Vail Village and Lionshead.

 

All delivery companies that serve businesses in Vail Village and Lionshead, with few exceptions, are required to obtain a loading dock permit. Delivery access via the loading docks at Arrabelle, Four Seasons, Mountain Plaza, One Willow, Sebastian and Solaris will not be allowed without a dock permit. Permit fees are calculated annually beginning in October and are prorated on a monthly basis. The tiered fee system is based on several factors such as number of delivery days per week, number of delivery locations in Lionshead and Vail Village, time needed at the dock for delivery, and the size of the truck. This ensures the dock permit fees are representative of the business.

Company Retirement Plans Required 1/1/2023

 

CMCA is reminding our members of an upcoming state mandate related to Colorado business owners.

Colorado businesses are required to offer the retirement plan to their employees if they:

  • Have been in business for two or more years
  • Have five or more employees
  • Do not already offer a retirement savings plan for employees

All Colorado business owners will need to register when the program launches in early 2023. If you don’t meet those requirements, you can file an exemption when you register. If you meet that criteria, you will need to enroll in the program in order to allow your employees to participate in the retirement savings program. Failure to register is expected to bring penalties from the state. Periodic traffic stops planned this week for rockfall maintenance work on WB I-70 at Georgetown

 

Clear Creek County ― Traffic holds are planned for rock scaling operations on westbound I-70 from 10 a.m. to 2 p.m., Tuesday - Thursday, November 8 - 10.  Westbound travel will be impacted during these times with intermittent traffic stops and delays.  Westbound motorists can avoid delays by planning their trips before and after the traffic holds.  No impacts to eastbound travel planned at this time. This work may be adjusted to maintain a safe working environment in changing weather conditions.
