EWA Files with PDV Reply Comments on PEBB
As reported in the
July 16 issue of
Insider, EWA and Pacific DataVision filed joint
Reply Comments that, among other matters, attempted to address industry concerns associated with proposed rules that would govern the 900 MHz band realignment and subsequent Private Enterprise Broadband and B/ILT narrowband operations. Key areas for FCC consideration are adjacent band interference mitigation, definitions of comparable facilities and the process for implementing realignment.

FCC Issues Public Notice on 800 MHz Interstitial Channels
On July 24, the FCC issued a
Public Notice inviting comment on proposed interference contours for use when coordinating interstitial 12.5 kHz channels in the 800 MHz “Mid-Band” band between 809-817/854-862 MHz. Five years ago, EWA had proposed making use of these interstitial channels. Since that proposal, the number of technologies that could be used in those channels has risen dramatically, requiring a more complex coordination process. On May 26, LMCC submitted a proposal to safeguard both new interstitial and 800 MHz incumbent operations from potential interference, which the FCC has included in the Public Notice. Comments will be due 30 days after publication of the Public Notice in the Federal Register. |
Vehicular Repeater Order Close
EWA anticipates the imminent release of an FCC Order that will permit the operation of vehicular repeater systems on six remote control and telemetry channels at 173 MHz, subject to coordination procedures to be adopted by the Land Mobile Communications Council. We also understand that other rule changes will permit the use of the channels at 12.5 kHz for data telemetry applications, and that state wide VRS systems will be permitted, but only on a secondary, non-interference basis. |
Formal Enforcement Bureau Reorganization Announced
On July 16, the FCC released an Order in which it implemented the expected reorganization of its Enforcement Bureau (EB) field offices. The FCC will close 11 of 24 field offices in an undisclosed period of time.

SNG Continues Its Quest
Spectrum Networks Group, LLC (SNG) has filed a Reply to the Oppositions submitted by EWA and two licensees in response to SNG’s Petition for Orders to Show Cause in which it has urged the FCC to investigate the eligibility of those two and other licensees of 900 MHz B/ILT frequencies. As reported in the
July 16
Insider, in its response to SNG’s Petition, EWA noted that the FCC has reserves for itself the responsibility for assessing eligibility and ownership. Coordinators have no authority to challenge statements in applications but may only assess whether the applications are complete and in compliance with the rules.
SGN’s Reply suggests some confusion on SNG’s part as to the FCC’s licensing and, in particular, its license assignment processes. Further, there seems to be a persistent lack of understanding regarding the facts provided by EWA in its Opposition and the scope of a coordinator’s authority vis-à-vis the applications it processes. It remains to be seen what, if any, action the FCC will take in response to the SNG Petition. |
