Lab Regulations Present New Challenges for Compliance
The Departments of Justice and Health and Human Services are steadily intensifying their pursuit of health care fraud and overpayment cases. Now more than ever, labs must stay up-to-date with ever-changing laws and regulations.
Among the many new lab compliance changes affecting labs in 2014, the “Final Rule” grants patients and patient representatives the rights to copies of completed lab test results within 30 days of the request, effective October 6, 2014. Previously, only allowed physicians and labs could view test information.
The Final Rule is a significant change that brings up serious questions: How should you authenticate the identity of a person requesting results? What liability does your lab face if it provides information to the wrong person? As your lab adjusts operations to comply with this new mandate, you need to know how to avoid the potential legal pitfalls of granting patients access to their records.
This and other timely lab compliance topics will be covered in depth at the G2 Intelligence Workshop on May 22, 2014, New Compliance Red Flags for Labs: How to Minimize Legal Risks in an Evolving Market.
Conference sessions will answer many pressing lab compliance questions, including:
- In the climate of increasing regulatory enforcement associated with the Affordable Care Act, how can a lab reduce the risk of being the target of an investigation?
- What must a lab do to remain in compliance with all state and federal laws?
- How can a lab conduct a self-audit to pinpoint trouble spots before they pose any threat?
- What is and is not allowed in terms of test pricing discounts?
- Are your lab’s sales and marketing campaigns in compliance with laws governing fraud, abuse, privacy, and data security?
- How can labs handle requests?
