Judge Rules It's Constitutional Ruling on one of more than a dozen cases now in the court system, Judge George C. Steeh of Federal District Court in Detroit ruled that choosing not to obtain insurance qualified as an example of “activities that substantially affect interstate commerce.” That is the standard set by the Supreme Court for Congress’s compliance with the Commerce Clause. Judge Steeh, who was appointed by President Bill Clinton, agreed with the federal government that not obtaining health coverage is effectively an active decision to pay for medical care out of pocket. “These decisions, viewed in the aggregate,” Judge Steeh wrote, “have clear and direct impacts on health care providers, taxpayers and the insured population who ultimately pay for the care provided to those who go without insurance.” Federal Judge will rule on Virginia Case by the end of the year U.S. District Judge Henry Hudson said he will rule by the end of the year on the constitutionality of the Obama administration's health care law. The case is proceeding separately from one in Florida, where a federal judge last week allowed a multistate challenge to go forward. The Virginia challenge is led by state Attorney General Ken Cuccinelli, who claims Congress lacks the constitutional authority to require Americans to buy health insurance or pay a penalty. He described the so-called individual mandate as "unprecedented" and warned Monday that personal "liberty" is on the line as the judge considers the case. This suit may have the most merit of any filed as the State of Virginia passed legislation prior the enactment of the Federal law that forbids mandatory health insurance purchases. Employers May Win Health Care Law Approval To Switch Carriers Employers may be allowed to switch their health insurers and still be shielded from costly coverage changes mandated in President Barack Obama’s health-care overhaul, a White House official said. Under the law passed in March, once companies change plans they must provide added services, including preventive care. The Administration through Health & Human Services is weighing whether to allow employers to avoid the requirements, even with a new insurer, as long as benefit levels stay the same, said a White House official who asked not to be identified because the talks are private. | ||||||||
